The Government has completed an Environmental Impact Assessment Study Report ("the EIA Report") for the dredging works necessary for the Cruise Terminal Development. The EIA Report was submitted under the Environmental Impact Assessment Ordinance ("EIAO") and is exhibited for public comment from 18 October 2007 to 16 November 2007 . The EIA Report may be downloaded from the Environmental Protection Department ("EPD") website at http://www.epd.gov.hk/eia/english/register/open/all.html during that period. Thereafter, tenderers may obtain a softcopy of the EIA Report that may be used solely for the purpose of preparing submissions for the tender for the grant of New Kowloon Inland Lot No. 6488 at the former Kai Tak Runway, Kowloon . Tenderers should note that the EIA Report being considered for approval by the Director of Environmental Protection ("DEP") under the EIAO may be subject to requests for further information following receipt, if any, of comments from the public and the Advisory Council on the Environment. Such further information would be uploaded to EPD's website with the EIA Report after a decision, if made, to approve the EIA Report by DEP.
A CD-ROM containing a softcopy of the EIA report may be collected from the Tourism Commission, 2nd Floor of Central Government Offices (East Wing), Lower Albert Road (at its junction with Garden Road), Hong Kong. Tenderers must give one working day's prior notice before collecting the CD-ROM by contacting the Tourism Commission, Commerce and Economic Development Bureau at telephone number (852) 2810 3136. |

The Government had gazetted the dredging works necessary for the Cruise Terminal Development under the Foreshore and Sea-bed (Reclamations) Ordinance on 10 August 2007 (G.N. 5141) and the objection period already expired on 10 October 2007. The Government will in due course seek authorization of the works as appropriate in accordance with the provisions of the Ordinance. |

On 6 November 2007, the Chief Executive in Council approved the draft Kai Tak Outline Zoning Plan (OZP) under section 9(1)(a) of the Town Planning Ordinance. The approved Kai Tak OZP No. S/K22/2 was gazetted under section 9(5) of the Ordinance on 9 November 2007 . The approved OZP shows the broad land use zonings and major transport networks planned for the Kai Tak area. DEP has issued an environmental permit under the EIAO on 7 January 2008, to the Civil Engineering and Development Department for the dredging works necessary for the Cruise Terminal Development. The Civil Engineering and Development Department has deposited with the Director of Environmental Protection, on 3 March 2008, a copy of the Waste Management Plan (WMP) for the dredged materials from seawall removal in accordance with Condition No. 2.10 of the Environmental Permit No. EP-284/2008. On 10 March 2008 , Civil Engineering and Development Department has surrendered, under Section 11 of the EIAO, the whole of the Environmental Permit (EP) No. EP-284/2008 for the Dredging Works for Cruise Terminal Development. Therefore, there is no valid EP for the dredging works. According to Section 26(1) of the EIAO, it would be an offense to carry out the dredging works without a valid EP. |
